Professor Qi Yanping published a paper on China Legal Science

Recently, Qi Yanping, a professor from School of Law of Beijing Institute of Technology, published a paper entitled "Legal Regulation in a Digitally Intelligent Society" in China Legal Science, one of the three core journals in the field of Chinese law. This paper is a phased achievement of the Ministry of Justice's 2018 Key Project of National Rule of Law and Legal Theory Research, named "Research on Big Data and Cybersecurity Legislation" (project approval number:18SFB1005).

Digitally intelligent logic is the integration of human and machine, the isomorphism of virtuality and reality, and the dominance of algorithm. The structuring and modeling of digitally intelligent social relations have revolutionized the way we perceive, grasp, and intervene in the world. The digitally intelligent meta-mechanism governs all behaviors and relationships, and the idea of law and legal practice will shift from "how to repair and restore society" to "how to discipline and shape society". The regulation of the society by law should be shifted forward from “judging the consequences of behavior” to “shaping the logic of behavior”, from post-event disposal to participation in the construction of the “framework” of social relations, and from empowerment and relief to the loading and regulation of responsibilities and obligations. The automatic operation of legal algorithms will become the norm, and the manual operation of laws will become the abnormal. The digitally intelligent logic destroys the right-based and judicial-centrism legal concept, and the entitlement jurisprudence will inevitably be replaced by the regulatory jurisprudence.

China Legal Science is a legal academic journal in the charge of and hosted by the China Law Society, and also an excellent journal funded by the National Social Science Fund. In various evaluation systems, the impact factor of China Legal Science has consistently ranked first in all national legal journals, making it the most influential and authoritative academic journal in the Chinese legal field. The results published in it represent the highest level of Chinese research in the field of law, and have played important roles in the prosperity and development of China's legal theory, the inheritance of legal culture, and the promotion of law exchanges at home and abroad.
